Terms & conditions

Please read these Terms of Service ("Terms") carefully. They govern your use of TerraCut's studio, website, booking platform, and all related services operated by Terra Pilates Studios LLC ("TerraCut," "we," "us," or "our"), located at 270 E Houston Street, New York, NY 10002. By creating an account, booking a class, or entering our studio, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use our services.


1. Accounts

To book classes and access member services, you must create an account. You agree to provide accurate and complete information and to keep it current. You are solely responsible for all activity that occurs under your account and must keep your password secure. Notify us immediately at info@terracutstudios.com if you suspect any unauthorized use of your account.

You may not use another person's account or allow others to use yours.


2. Class booking and cancellation policy

Reservations

All classes must be reserved and paid for in advance through our online booking system. You must be physically checked in at the start of class or your spot may be released to a waitlisted client without refund.

10-hour cancellation window

Cancellations must be made at least 10 hours before the scheduled class start time. Cancellations made within that window — or no-shows — will result in forfeiture of the class credit or a late cancellation fee, as applicable to your membership type.

Late cancellation fee: $25, inside 10 hours of class start.

Check-in window

All clients must check in no later than 2 minutes before class start time. Spots may be released to the in-person waitlist 2 minutes prior to class start, and a released spot will not be refunded.

Waitlist

If you join the waitlist and elect to move into a class, it is your responsibility to cancel at least 10 hours before class if you cannot attend. Being added from the waitlist does not exempt you from the cancellation policy.

Late cancellation fees

Members on unlimited or recurring membership plans will be charged a $25 late cancellation fee for any cancellation made within the 10-hour window or for no-shows. Fee amounts are posted on our booking platform and our website and are subject to change with reasonable notice.


3. Membership and payments

Founding membership

TerraCut's founding membership is limited to 100 members. Founding member pricing and benefits are as specified at the time of enrollment and are subject to the terms communicated at signup. Founding membership status does not guarantee any specific class time, instructor, or format.

Recurring billing

Memberships are billed on a monthly basis. By enrolling in a membership, you authorize TerraCut to charge your payment method on a recurring basis. TerraCut will not collect payment for more than three (3) months of membership in advance.

Cancellation of membership

You may cancel your membership at any time by contacting us at info@terracutstudios.com or in person at the studio. Cancellations require 30 days' written notice prior to your next billing date. You will retain access to the studio through the end of your paid period.

Class packages

Class packages are non-transferable, non-shareable, and expire on the date specified at purchase. Unused classes will not roll over and are non-refundable after expiration.

No refunds

All sales of class packages, memberships, and related services are final and non-refundable. No exceptions, except as required by applicable New York law (see Section 9 below).

Price changes

TerraCut reserves the right to adjust pricing with reasonable advance notice. Changes will not apply to active prepaid periods.

Payment on file

A valid credit or debit card must be on file for all active accounts. TerraCut is not responsible for any bank fees or overdraft charges related to billing.


4. Membership freeze

Active members may freeze their membership once per calendar year for up to two (2) weeks at no charge. To request a freeze, contact us at info@terracutstudios.com at least 7 days before your desired freeze start date.

If you are unable to use the studio due to a documented medical condition or injury, you may request an extended freeze beyond two weeks. Medical freezes require a physician's note and are approved at TerraCut's discretion. During an approved medical freeze, your membership will be paused and your billing date extended accordingly.

Freezes do not apply to class packages.


5. Studio rules and conduct

TerraCut is a space built on real community — the kind where you feel seen, not performed at. To protect that environment for everyone, the following rules apply:

  • Arrive on time. Late arrivals may not be admitted to class and will be treated as a no-show.
  • Wipe down your reformer after every class.
  • No unattended children or pets in the studio.
  • Do not film or record classes, instructors, or other clients without prior written consent from TerraCut management. Instructors are not authorized to grant recording permission.
  • Do not film content that reveals TerraCut's proprietary class structure, programming, or coaching methods.
  • You are permitted to film yourself before or after class, provided other clients and staff are not identifiable without their consent.
  • Use equipment only as directed by your instructor.
  • Inform your instructor before class if you are recovering from an injury, illness, or pregnancy.
  • TerraCut reserves the right to refuse entry or remove any person from the studio at any time, in its sole discretion.

Violation of studio rules may result in suspension or permanent termination of your membership without refund.


6. Non-harassment policy

TerraCut is committed to providing a safe, respectful, and inclusive environment for all members, instructors, and staff. Harassment of any kind — including verbal, physical, or digital conduct based on race, ethnicity, gender, gender identity, sexual orientation, religion, national origin, age, disability, or any other protected characteristic — will not be tolerated.

If you experience or witness harassment at TerraCut, we ask that you report it as soon as possible by contacting us at info@terracutstudios.com or speaking directly with the studio manager. Please provide as much detail as possible, including the date, time, location, names of any witnesses, and a description of what occurred.

TerraCut will review all reports promptly and take appropriate action, which may include warning, suspension, or permanent removal from the studio. Confidentiality will be maintained to the extent practicable. TerraCut's duty to investigate may require sharing limited information with relevant parties.

Retaliation against anyone who reports harassment in good faith is strictly prohibited and itself grounds for removal.


7. Health, safety, and assumption of risk

By booking a class, entering the studio, or participating in any TerraCut program, you acknowledge and agree to all of the following:

  • You are in adequate physical condition to participate in strenuous physical exercise.
  • You do not have any medical condition, injury, or disability that would make participation dangerous without medical clearance.
  • You understand that Pilates reformer training involves inherent risks, including but not limited to: muscle strain, joint injury, falls, cardiovascular events, and in extreme cases, death.
  • You have voluntarily chosen to participate and assume all such risks.
  • TerraCut's instructors provide coaching and corrective guidance, but their instruction does not constitute medical advice.
  • If you are pregnant, you must inform your instructor before class and confirm that you have received medical clearance to participate.

To the fullest extent permitted by law, you hereby release and hold harmless TerraCut, its owners, instructors, employees, and agents from any and all claims, liability, damages, injury, or death arising from your participation in TerraCut classes or your presence in the studio, whether caused by negligence or otherwise.

TerraCut reserves the right to deny participation to any individual whose health or conduct, in TerraCut's sole judgment, poses a risk to themselves or others.


8. Personal belongings

TerraCut is not responsible for the loss, theft, or damage of any personal belongings brought into the studio. You assume all risk of loss for items left on the premises.


9. New York consumer rights — right to cancel

You may cancel your purchase of TerraCut classes or membership without any penalty or further obligation within three (3) business days from the date of your initial purchase.

To exercise this right, your notice of cancellation must be in writing, signed by you, and submitted by one of the following methods within the 3-business-day window:

  • Email to info@terracutstudios.com with the subject line "Cancellation Notice"
  • Delivered in person at 270 E Houston Street, New York, NY 10002

You will receive a full refund of your purchase within 15 business days of TerraCut's receipt of your valid cancellation notice.

You may also cancel your membership or class package — and receive a pro-rated refund of unused amounts — for any of the following reasons:

  • A physician orders you to stop participation due to a significant physical disability lasting more than six (6) months.
  • You die (your estate may cancel on your behalf).
  • You permanently relocate your residence more than 25 miles from any comparable TerraCut location.
  • TerraCut ceases to offer services as described at the time of your purchase.

All refunds for the above reasons will be issued within 15 days of receipt of written notice of cancellation. TerraCut may retain the portion of fees representing classes or services already used.

Note on financial security: TerraCut does not collect more than three (3) months of payment in advance and therefore is not required to post a bond or other financial security under New York health club law.


10. Intellectual property

"TerraCut," the TerraCut name, logo, visual identity, class programming, coaching methodology, and all content on our website and booking platform are the proprietary property of Terra Pilates Studios LLC and may not be used, copied, reproduced, or distributed without prior written permission.

You may not use TerraCut's name, branding, or any derivative thereof in connection with any product, service, or domain name without our express written consent.


11. Schedule and instructor changes

Instructors and class formats are subject to change without notice. TerraCut will make reasonable efforts to communicate changes in advance, but does not guarantee the availability of any specific instructor, class time, or format. No refunds will be issued due to instructor or schedule changes.


12. Limitation of liability

To the maximum extent permitted by applicable law, TerraCut's total liability to you for any claim arising out of or related to these Terms or your use of TerraCut's services — whether based in contract, tort, or otherwise — shall not exceed the total amount you paid to TerraCut in the three (3) months immediately preceding the event giving rise to the claim.

TerraCut shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or data, even if advised of the possibility of such damages.


13. Dispute resolution and arbitration

We hope any issues can be resolved informally. If you have a concern, please contact us first at info@terracutstudios.com. We'll make a good-faith effort to resolve it within 30 days.

If we cannot resolve the dispute informally, you and TerraCut agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of TerraCut's services shall be resolved by binding individual arbitration, rather than in court. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

You and TerraCut each waive the right to a jury trial and to participate in any class action or representative proceeding. All disputes must be brought in an individual capacity only.

Either party may seek relief in a small claims court for disputes within that court's jurisdiction. This arbitration agreement does not limit your statutory rights under New York law.

Governing Law: These Terms are governed by the laws of the State of New York, without regard to conflict of law principles.


14. Indemnification

You agree to indemnify, defend, and hold harmless TerraCut and its owners, officers, employees, instructors, and agents from and against any claims, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of: (a) your use of TerraCut's services; (b) your breach of these Terms; or (c) your conduct in or around the studio.


15. Privacy and communications

By creating an account, you consent to receive transactional communications from TerraCut related to your bookings, membership, and studio operations. We will not sell your personal information to third parties. By opting in to marketing communications, you agree to receive promotional messages, which you may opt out of at any time.


16. Changes to these terms

TerraCut reserves the right to update or modify these Terms at any time. Material changes will be communicated to you by email or notice posted on our booking platform. Your continued use of TerraCut's services after any such change constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.


17. Entire agreement

These Terms, together with any additional policies referenced herein, constitute the entire agreement between you and TerraCut regarding your use of our services. If any provision is found to be unenforceable, the remaining provisions will continue in full force and effect. TerraCut's failure to enforce any provision shall not constitute a waiver of that right.
